College and University Law
McQuaide Blasko’s College and University Law Practice Group has represented public and private colleges and universities across nine decades. We help these clients with the same types of matters we help our non-university clients with, such as civil litigation, employment matters, business and real estate transactions, and more. We also have extensive experience with the types of issues that specifically come up in the context of higher education:
- Tenure denial and faculty performance issues, including termination of employment;
- Student discipline, including policy violations, code of conduct issues, academic integrity, due process, and Title IX “reverse discrimination” litigation, like erroneous outcome and selective enforcement lawsuits;
- Faculty, staff, and student civil rights issues, such as discrimination, disability accommodation, etc.;
- Athletics issues, including Title IX compliance;
- Constitutional issues involving faculty and students, like free speech, free exercise of religion, search and seizure, due process, and equal protection;
- Labor law compliance under the Public Employe Relations Act (PERA);
- Tax exemptions;
- Family Educational Rights and Privacy Act (FERPA);
- Intellectual property, such as trademark and copyright;
- Affirmative action plans; and
- Faculty and staff employment issues.
